North Cowichan appeals for access to Chemainus well

The district North Cowichan is asking the B.C. Court of Appeal to give it the right to draw water from a well in Chemainus after a judge in October told the district to turn off the taps.

Last summer, a Supreme Court judge ruled that the Halalt First Nation hadn’t been properly consulted before the province allowed the well to be built near the reserve on the Chemainus River.

The district was banking on using the Chemainus aquifer to avoid yearly boil water advisories in the community.

Lawyers representing the province, the district of North Cowichan and the Halalt First Nation are expected to wrap up their arguments Friday.
